Após três ministros do Supremo Tribunal Federal (STF) terem apresentado votos contrários à manobra jurídica da gestão da Petrobrás de criar subsidiárias para facilitar a privatização das refinarias, sem autorização do Congresso Nacional e sem licitação, o presidente do tribunal, Luiz Fux, pediu destaque da Reclamação 42576, que estava sendo julgada em modo virtual desde a última sexta-feira, 18.
Com isso, a sessão foi interrompida e o julgamento do processo será remetido ao Plenário do STF, onde os ministros que já haviam votado terão que fundamentar novamente os seus votos na sessão por videoconferência. A análise do caso em plenário ainda não tem data definida.
A suspensão do julgamento virtual ocorreu logo após os ministros Edson Fachin, Ricardo Lewandowski e Marco Aurélio Mello terem se posicionado contrários à manobra da gestão Castello Branco, que colocou à venda metade do parque de refino da Petrobrás, atropelando determinação do próprio STF, que proibiu privatizações em estatais matrizes sem autorização legislativa.
O julgamento é referente à Reclamação 42576 feita pelas mesas diretoras do Senado e da Câmara dos Deputados Federais, após denúncia durante a greve dos petroleiros, em fevereiro deste ano.
No primeiro dia do julgamento, o ministro relator do processo, Edson Fachin, acatou pedido de liminar para interromper o processo de venda das refinarias, ante o desvio de finalidade que transforma as plantas em subsidiárias com o único intuito de privatiza-las sem autorização legislativa. No sábado e na segunda-feira, ele teve o voto acompanhado pelos ministros Ricardo Lewandowski e Marco Aurélio Mello, respectivamente.
